How we protect personal data

TBA Advocaten takes the protection of your data seriously and takes appropriate measures to prevent misuse, loss, unauthorised access, unwanted disclosure and unauthorised changes.

TBA Advocaten processes your data while respecting appropriateness, honesty, legality, retention limits, proportionality, finality of processing, integrity and confidentiality.

Personal data we process

TBA Advocaten processes your personal data because of our statutorily defined obligations, because we have concluded a consultation and/or assistance agreement and/or because you (have) provided it yourself to us.

- First and last name
- Sex
- Date of birth and place, but only to the extent that you fall within the scope of the anti-money laundering law (see below)
- Address information
- Phone
- E-mail address
- Bank account number
- Other financial information

Special and/or sensitive personal data that we process

TBA Advocaten (possible) processes (possibly) the following special and/or sensitive personal data about you:

- criminal record, offenses or convictions
- data of persons under the age of 16 years
- personal data which display political views or the membership of a trade union or data related to a person's sexual behaviour or sexual orientation.

The processing of this data is necessary to bring, pursue or substantiate a legal action, in the context of the consultation or assistance agreement concluded with you.

For what purpose and on what basis do we process personal data

TBA Advocaten processes your personal data for the following purposes:

1. To meet the anti-money laundering obligation that TBA Advocaten has (see on this matter http://www.tba.be/nl/witwaswetgeving)

If the engagement you wish to entrust to us falls within the scope of the money laundering law (see the link above), we are required to identify our clients and to request, verify and preserve a number of documents as evidence of that identity by means of a copy of your ID card. We shall also have to ask you about the provenance of funds or assets.

In this context, we must collect (and verify) the following personal data):
     o If you are a natural person: your last name, first name, date and place of birth and, as far as possible, your address;
     o If the client is a company: the list of directors being a natural person.

2. For the performance of our consultation or assistance agreement.

    For this reason, we process your last name, first name, phone, address and e-mail address, so that we can remain in touch and notify you about the status of your case in a thorough manner.

     For the processing of (possible) payments we need your bank account number.

     We only process financial data if this proves to be absolutely necessary for conducting proceedings or for billing purposes.

3. For purposes of representing the legitimate interests of TBA Advocaten.

     For this reason, we process your gender in order make a correct form of address possible.

Automated decision-making

TBA Lawyers shall not make decisions by means of automated processing, regarding matters that may have significant consequences for people.

This concerns decisions that are made by computer programs or systems, without a person (for example an employee of TBA Advocaten) being in between.

How long do we keep personal data

TBA Advocaten does not keep your personal data longer than is strictly necessary to achieve the purposes for which your data is being collected.

Your data shall be kept, while respecting the retention limits principle, or a period of five years after the termination of our agreement. This period is a legal minimum period. Afterwards, this data shall be destroyed.

Sharing personal data with third parties

TBA Advocaten shall not sell your data to third parties and shall only provide it if this is necessary to meet our legal obligations and exercise our legal powers or to perform the agreement with you, for example, in the context of possible proceedings.

We are concluding a data processing agreement with companies that process your data on our behalf to ensure the same level of security and confidentiality of your data.

TBA Advocaten remains responsible for this data processing.

Cookies, or similar techniques, that we use

TBA Advocaten uses only technical and functional cookies, and analytical cookies that do not infringe on your privacy.

The cookies we use are necessary for the technical operation of the website and your ease of use. They ensure that the website works properly and remember, for example, your preferences. Your rights

You have the right to request TBA Advocaten for:
- information about the identity of the recipients or categories of recipients of personal data to the extent that they exist;
- access to and rectification or erasure of your personal data; or
- in case of dispute, to limit the data processing with regard to your personal data; or
- to receive a free copy of the processed personal data, unless such request is manifestly unfounded or excessive; or
- object to the processing of your data for specific purposes. In this context, you must also, in the dated request mentioned below, state the reasons relating to your particular situation based on which you object to the processing of data. However, this right only applies, in so far as your personal data is concerned, to the gender.
- the right to obtain the personal data you have provided to us in a machine-readable and common form and to transfer it to another controller.

That means also that you may submit a request with us to send to you, or an organisation named by you, the personal data, that we hold about you.

You may send a request for access, rectification, deletion, data transfer of your personal data or a request for withdrawal of your consent, or an objection to the processing of your personal data, to info@tba.be

To ensure that the request for access has been made by you, we shall ask you to join a copy of the front of your ID card to the request. Black out the passport photo, MRA (machine readable area, the strip with numbers at the bottom of the passport) and the passport number. This is to protect your privacy.

TBA Advocaten maintains as its policy to respond to your request as soon as possible, but at the latest in thirty days.
